Eamon Tyrrell and Jason Behan to appeal three-year ban over Casela Park
• Pair to seek judicial review following BHA ruling• Irish Turf Club will reciprocate ban if appeal failsEamon Tyrrell and Jason Behan, the trainer and jockey banned from the sport over the running and riding of a horse at Newcastle two months ago, both intend to seek a judicial review after the British Horseracing Authority confirmed that the pair would be disqualified for three years."It's astonishing, but I can't say anything more," said Tyrrell, trainer of Casela Park, who finished sixth, beaten only a couple of lengths and seemingly running on well, despite being subjected to what the BHA disciplinary panel described as "strong and persistent episodes of restraint".A summary of the findings of the panel, distributed by the BHA, said: "The gelding was manoeuvred several times away from gaps and back behind other runners. But for its treatment by Behan, it would have won."That may seem a strong conclusion about a race in which it finished sixth, but the more the panel viewed the recordings, the more it felt driven to this view."Although the "entry-point" for the offence was a ban of 18 months, the panel concluded that such a "fundamental breach of the rules" merited a stiffer punishment – a decision exacerbated by the "untrue accounts" given by the jockey and the trainer. The Irish Turf Club's chief executive Denis Egan confirmed that, subject to appeal, the bans would be reciprocated in Ireland with immediate effect. But Andrew Coonan, chairman of the Irish Jockeys' Association, said: "We are all conscious that the integrity of racing has to be protected, but to deprive someone of the entitlement to earn a livelihood for three years is a very serious matter."Horse racingWill Haylerguardian.co.uk © Guardian News & Media Limited 2010 | Use of this content is subject to our Terms & Conditions | More Feeds guardian.co.uk |
